Your AI scribe needs one thing before it starts listening.

In California, patients have filed proposed class actions. They allege health systems recorded their visits with an AI scribe, without their consent.

States are paying attention too. Maine passed a law that requires mental health professionals to get patient consent before using ambient listening tools.

So what can a practice do? Advice in Medical Economics this month was simple. Ask the patient, and get a clear yes. Put AI in your notice of privacy practices. And decide ahead of time what happens when a patient says no.

I build AI tools for a primary care practice. The tool is the easy part. The process around it is what protects you.

That one thing is consent. So here's my question. Does your practice ask before the scribe starts listening?
